Questions workers ask

What if a worker is denied a heat cool-down rest?▾
The employer owes one extra hour of pay at the regular rate for that workday. Labor Code Section 226.7 sets this premium, and Cal/OSHA's Title 8 Section 3395 treats cool-down rest as a recovery period. Recovery periods count as hours worked.
Do early site inspections count toward overtime?▾
Yes, when the employer requires them. Required inspections are hours worked. IWC Wage Order 16, enforced by DIR's Labor Commissioner, generally requires overtime after eight daily or 40 weekly hours for nonexempt construction employees.
Do I pay for a respirator my job requires?▾
No. Cal/OSHA's Title 8 Section 5144 requires employers to provide required respirators, training and medical evaluations at no cost to the employee. Report any deduction for this equipment to payroll.
