Questions workers ask

Does receiving a salary remove a working foreman's overtime rights?▾
No. Virginia Code § 40.1-29.2 applies the federal executive exemption, which requires a qualifying salary, management as the primary duty, supervision of two full-time employees and real personnel authority. A foreman who mainly performs manual trade work still earns overtime after 40 weekly hours.
Can I be disciplined for discussing pay with my crew?▾
No. Virginia Code § 40.1-28.7:9 bars employers from retaliating against employees who discuss their own or coworkers' wages. The exception covers staff who access others' pay records as an essential job function and disclose them.
Can I sue over an unpaid production bonus?▾
Yes. Virginia Code § 40.1-29 counts bonuses as wages and lets you sue your employer directly. Courts award the unpaid amount, an equal sum in liquidated damages, interest and attorney fees, or triple wages when the employer knowingly withheld pay.
